These Terms of Service (“Terms”) govern your use of the Mare and Mane booking application (“the App”), operated by Mare and Mane (“Mare and Mane,” “we,” “us,” or “our”), a Florida-based equine services business. By creating an account, browsing services, or completing a booking through the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
WARNING
Under Florida law, an equine activity sponsor or equine professional is not liable for an injury to, or the death of, a participant in equine activities resulting from the inherent risks of equine activities.
— Fla. Stat. § 773.04(2)
By booking any service through the App, you acknowledge that equine activities involve inherent risks, including but not limited to: the propensity of an equine to behave in ways that may result in injury, harm, or death to persons on or around them; the unpredictability of an equine’s reaction to sounds, sudden movement, and unfamiliar objects, persons, or other animals; certain hazards such as surface and subsurface conditions; collisions with other equines, objects, persons, or vehicles; and the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, which could result in serious injury or death.
You assume all risks inherent in equine activities as described in Chapter 773, Florida Statutes. This release does not apply to injuries caused by our negligence that falls within the exceptions set forth in Fla. Stat. § 773.03(2), including: faulty equipment or tack we knew or should have known about; our failure to reasonably match an equine to a participant’s abilities; or a known dangerous latent condition on our property or the property where the activity takes place that we did not make known to you.
As part of each booking, you (or, if booking for a minor, the parent or legal guardian) will be required to electronically sign an acknowledgment of this warning notice. This in-app signature does not replace any physical signage posted at our facility or the event location, which may also be required under Florida law.
Booking. Services are booked through the App on a first-come, first-served basis. Availability is not guaranteed until a booking is confirmed. For events requiring a deposit, the booking is confirmed upon successful payment of the deposit.
Event time slots. Pony ride events are available on Saturdays and Sundays only, from September through May, during the 10:00 AM – 12:00 PM and 2:00 PM – 4:00 PM time windows.
Deposits. The following deposit amounts are required at the time of booking for events: Birthday Pony Ride — $125; Private Event Pony Ride — $125; Wedding — $250; Class Visit — $100. Deposits are non-refundable except as provided below. Schools booking a Class Visit are tax-exempt and should provide a tax-exempt certificate.
Cancellation. You may cancel an appointment through the App. Cancellations made more than 4 hours before the scheduled event start time are free of charge. Cancellations made within 4 hours of the scheduled event start time are subject to a $200 late cancellation fee, charged through the App at the time of cancellation.
No-shows. If you fail to appear for a scheduled appointment without cancelling, you will not be entitled to a refund of any deposit paid, and you may be charged the late cancellation fee.
Weather and staff unavailability. We reserve the right to cancel or reschedule any appointment due to inclement weather, equine illness, or staff unavailability. In such cases, you will be offered a rescheduled appointment or a full refund of any deposit paid.
Refund timing. Approved refunds will be processed within 7–10 business days to the original payment method.
Monthly boarding is offered at $2,150 per month on an auto-renewing subscription basis through the App.
Care standards. We provide standard boarding care including stall, feed, water, and daily turnout. Additional services may be available at extra cost.
Horse health. You are responsible for providing accurate health records, vaccination status, and emergency contact information for your horse. In the event of a medical emergency, we are authorized to contact a veterinarian on your behalf, and you are responsible for any veterinary costs incurred.
Agister’s lien. Pursuant to Florida law, we may assert a lien on any horse boarded with us for unpaid boarding fees. If boarding fees remain unpaid for more than 30 days, we may, after written notice to you, exercise our lien rights, which may include the sale of the horse to satisfy the debt, in accordance with Florida law.
Nonpayment and removal. If subscription payments are not current, we reserve the right to suspend boarding services and require removal of the horse. You will be responsible for all unpaid fees and any costs of collection.
A separate written boarding agreement may be required in addition to these Terms.
Many of our services, including birthday pony rides, class visits, and riding lessons, involve minor participants. If you are booking a service on behalf of a minor:
The account holder must be at least 18 years of age. Minors may not create their own accounts.

Equine services involve inherent risks that cannot be eliminated. We do not guarantee the safety of any participant.
To the maximum extent permitted by law, our aggregate liability for any claims arising out of or related to the App or these Terms (excluding personal injury claims governed by Chapter 773, Florida Statutes, which are addressed in the Equine Activity Warning Notice above) shall not exceed the amount you paid us for the specific booking giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
You agree to indemnify and hold harmless Mare and Mane from any claims, damages, or expenses arising from: your misuse of the App; your violation of these Terms or applicable law; your infringement of any third-party rights; or any content or information you submit through the App.
Payments are processed through the App via our payment processor, Base44 Payments (Wix Payments). Your payment information is handled by the processor and is subject to the processor’s terms and privacy policy. We do not store your full credit card or payment card details.
Some payments may be handled outside the App at our discretion. In such cases, payment terms will be communicated to you directly. Subscription payments (e.g., boarding) are billed on a recurring monthly basis until cancelled. You may cancel your subscription at any time through the App.
We may suspend or terminate your account and access to the App at any time, with or without cause, including for violation of these Terms, fraudulent activity, or abuse of the booking system. You may close your account at any time through the App’s settings.
The App integrates with third-party services including payment processing and scheduling tools. We are not responsible for the practices or actions of these third parties, and their use is subject to their own terms and privacy policies.
We may modify, suspend, or discontinue any service or feature of the App at any time without prior notice. We are not liable to you for any such changes.
We may update these Terms from time to time. We will notify you of material changes through the App or by other means. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Florida. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in the county where Mare and Mane maintains its principal place of business.
The parties agree that any dispute arising from these Terms shall be resolved through binding arbitration in the State of Florida under the rules of the American Arbitration Association, and that each party waives the right to participate in a class action lawsuit or class-wide arbitration.
